First Arab Consumer Protection Forum

The authorities participating in the First Arab Consumer Protection Forum, believing in the necessity of combating commercial fraud, imitation and infringement on intellectual property rights, and as their contribution to the protection of society and consumer rights – as well as the rights of inventors, owners of original products, and facilitation of fair international trade – declare that these matters constitute important issues for all countries, and that the spread of commercial fraud would bring about adverse effects to all parties dealing in counterfeit products, including but not limited to:

• Direct damage to the national economy of countries for failure to protect intellectual property rights for individuals and companies.

• Threatening of consumers’ safety as a result of using pirated and/or counterfeit products.

• Damages sustained by companies and owners of trademarks, and creation of a dangerous environment that hampers investment and development.

Whereas, the objectives of this Forum are to discuss the problems and the proposed solutions, develop such solutions, find opportunities for a fruitful and constructive cooperation to minimize the effects of commercial fraud, which is a crime; and whereas, the authorities participating in the Forum firmly believe in the importance of joint efforts in combating this crime, taking into consideration that this can only be accomplished by cooperation at international levels, therefore, the participating authorities assert that one of the priorities of the authorities in all countries is to stop the spread of commercial fraud and pirated and imitation products in their markets. This Forum announces the importance of adopting the following recommendations:

 

1. To ensure the importance of international cooperation to combat commercial fraud, imitation and infringement on intellectual property rights in order to cut the sources of commercial fraud and imitation by fighting them directly at their points of origin, i.e., in countries that manufacture, transport and consume these counterfeit products, and by exchanging relevant information to one another.

2. To approve the first day of March each year as Arabian Consumer Day, through which an awareness campaign shall be carried out in all Arab states by the authorities having jurisdiction to protect consumers.

3. To accelerate the passage of laws in respect of confiscation and destruction of pirated and counterfeit products, and not to allow rectification of counterfeit violations or re-exportation of the confiscated counterfeit products.

4. To intensify the role of competent authorities in the market surveillance to prevent exchange and sale of pirated and counterfeit products, which constitute an infringement on intellectual property rights.

5. To call on the owners of genuine products to reduce the prices of their products and after-sales services as a means for combating fraud and counterfeit, in order for consumers to refrain from resorting to counterfeit products.

6. To activate the role of the private sector in supporting the relevant government sectors, in order to minimize the spread of counterfeit and pirated products.

7. To intensify training programs for the employees of governmental sectors having jurisdiction to combat commercial fraud and counterfeit.

8. To adopt anti-commercial fraud campaigns and programs, in order to raise the level of awareness of the public and private sectors, as well as the consumers.

9. To build unified and consolidated database serving the participating sectors in terms of developing mechanisms and programs for consumer protection and combating commercial fraud and imitation.

10. To apply risk management regulations, to be targeted against the offenders, within the authorities having the power to combat commercial fraud and imitation.

11. To encourage incorporation of special laboratories in all Arab states to examine imported products, in order to re-assure that they are neither imitation nor pirated, and to provide such services at reasonable prices.

12. To toughen the penalties in respect of consumer safety and health products violations, including medicines, which directly affect the citizens’ health and safety.

13. To observe transparency principles in dealing through exchange of information between private and public sectors, in order to support development and building-capabilities programs.

14. To foster cooperation between public and private sectors in laying down strategic plans, in order to protect intellectual property rights and minimize commercial fraud and imitation, through periodical meetings to deliberate on the matter and to work towards implementation of the objective programs for combating this phenomenon in line with established priorities

15. To call on the Customs Executives in the Arab states to raise and encourage more incentives for their staff in order to combat commercial fraud and imitation.

16. The call for official documentation and consolidation of Arab Geographical and historical Indications; and Famous Arab Brand Names in order to protect the heritage and intellectual property rights of trade names and locations, Preventing un-authorized / illegitimate use of these names and locations in the future.

While we are concluding the activities of the First Arab Consumer Forum and these new initiatives, we hope that our efforts will be successful in gathering the words of the concerned and interested parties and consolidating those efforts. We have to admit that we still have a long way to go to successfully accomplish our objectives, and with the help of Allah, even if there are shortcomings, we promise that the next step will be to comply with your thoughts and visions to make our Arab society safe from commercial fraud and imitation.
